We will ask you or your legal advisor to complete a mediation referral form,
which provides us with some basic information of the parties involved and the
nature and brief description of the case.
We would briefly outline the process of mediation, how it works and what will
be expected of you. Subject to your agreement to mediation we will contact
the other party, or their advisors, to get their agreement to mediate. If this
is agreed we will send to you and other parties copies of the Mediation Agreement,
and arrange a date and venue suitable to all parties. We will ask both parties
to submit to us a description of the case and a position statement.
Mediation is a voluntary process and either party is free to walk away at
any time before or during the mediation. The decision to mediate is entirely
up to you and of course the other party. It is private, conducted without prejudice
and with absolute confidentiality. The outcomes are not made public, unlike
most court proceedings.
It is non-binding unless and until an agreement is reached. If you reach
an agreement you will leave the mediation with a Settlement Agreement signed
by both parties.
You may, if you wish, have your legal advisors make your Settlement Agreement
a legally binding document.
